Terms of use
Last updated: 4 November 2026
Scandish (scandish.app) is a digital menu and table ordering service for restaurants, provided by Scandish ("Scandish", "we"). Contact: info@scandish.app.
Part A applies to guests who use Scandish to order in a restaurant. Part B applies to restaurants and other businesses that use Scandish ("customers"). Part C applies to everyone.
Part A – Guests
A1. What Scandish does
By scanning the QR code on your table you can view the restaurant's menu, order, call a waiter, follow your order and see your bill. Scandish provides the technology; the restaurant sells the food and drinks. Your purchase contract is made with the restaurant, not with Scandish.
A2. Orders
Your order is sent to the restaurant when you confirm it. The restaurant may accept or reject an order, for example if a dish has sold out. Prices are set by the restaurant and include VAT. Everyone at the table can add to the same order, so check your cart before sending.
A3. Payment
You pay the restaurant directly, as the restaurant instructs (for example by card or cash to the staff). Scandish does not handle payments or card details.
A4. Allergies and dietary information
Allergen and diet information is entered by the restaurant, and Scandish is not responsible for its accuracy. Recipes and ingredients can change. If you have an allergy or a special diet, always confirm with the staff before ordering and eating.
A5. Fair use
Do not send false, joke or disruptive orders or requests, and do not try to access other tables, restaurants or parts of the service you are not meant to see. The restaurant may reject orders, and we may block access, if the service is misused.
A6. Problems
If the ordering page does not work, you can always order directly from the staff. Questions about the food, the service or your bill are handled by the restaurant. Your statutory consumer rights are not limited by these terms.
Part B – Restaurants and other business customers
B1. Agreement
These terms form the agreement between Scandish and the customer, together with the order confirmation or offer that states the chosen package, prices and start date. If they conflict, the order confirmation or offer prevails. The person accepting the agreement confirms that they are authorised to bind the customer. Scandish is offered to businesses only; consumer protection law does not apply to Part B.
B2. The service
Scandish provides the service in the package the customer has chosen. We continuously develop the service and may change, add or remove features, provided that the main functions of the customer's package are not materially reduced during a paid period. The service is provided "as is" and "as available".
B3. Availability and support
We aim to keep the service available at all times, but we do not guarantee uninterrupted or error-free operation. The service depends on internet connections, devices and third-party providers that are outside our control. We try to carry out maintenance at quiet times and tell customers about planned breaks in advance when possible. Support is provided by email on business days. The customer must always have a way to take orders without the service (for example directly by staff).
B4. Customer's responsibilities
The customer is responsible for:
- the content it adds to the service: menus, prices, VAT, descriptions, photos, allergen and diet information, and that it has the right to use photos and texts it uploads,
- complying with food safety, consumer, pricing, alcohol, accounting and other laws that apply to its business,
- the food, drinks and service it sells to guests, and all payments, receipts and refunds to guests,
- its staff accounts: keeping passwords safe, giving access only to the right people and removing accounts that are no longer needed,
- the devices and internet connection it uses,
- informing guests where needed, for example by linking to this privacy policy.
B5. Prices and payment
Prices are those in the order confirmation or our price list at the time of ordering. A one-time setup fee may apply. Monthly fees are invoiced in advance. Prices do not include VAT, which is added according to law. Payment term is 14 days net unless agreed otherwise. Late payments carry interest under the Finnish Interest Act. If an invoice is more than 14 days overdue, we may suspend the service after a written reminder until it is paid. We may change prices by giving at least 30 days' notice; the customer may then terminate the agreement to end when the new price takes effect.
B6. Trial
Free trials last the period we agree. A trial ends automatically unless the customer orders a paid package. Data added during a trial may be deleted 30 days after the trial ends.
B7. Term and termination
Unless otherwise agreed, the agreement is valid until further notice and either party may terminate it with one calendar month's notice to the end of a calendar month. Yearly (prepaid) agreements continue for the agreed period and renew for the same period unless terminated at least one month before the end. Fees already paid are not refunded, except where Scandish terminates without cause or as required by law. Either party may terminate with immediate effect if the other party materially breaches the agreement and does not remedy the breach within 14 days of written notice.
B8. Data and data protection
The customer owns the data it adds to the service. For guest personal data, the customer is the controller and Scandish is the processor. Scandish:
- processes personal data only to provide the service and according to the customer's documented instructions, which are these terms and the settings the customer chooses,
- ensures that people who process the data are bound by confidentiality,
- takes appropriate technical and organisational security measures,
- uses only the sub-processors listed in the privacy policy, and informs customers in advance of new ones so that they can object,
- helps the customer to answer data subjects' requests and to meet its other GDPR obligations, as far as reasonable,
- informs the customer without undue delay after becoming aware of a personal data breach affecting the customer's data,
- deletes or returns the customer's data after the agreement ends (see B9), unless the law requires keeping it,
- gives the customer the information needed to show compliance with GDPR article 28.
Scandish may use anonymised and aggregated data, which cannot identify a restaurant or person, to develop and improve the service.
B9. When the agreement ends
The customer can export its reports before the agreement ends. We delete the customer's data within 90 days after the end of the agreement, except data we must keep by law. Backups are overwritten on a rolling basis.
B10. Intellectual property
Scandish and all its software, design and brand belong to Scandish or its licensors. The customer gets a non-exclusive, non-transferable right to use the service for its own business during the agreement. The customer may not copy, resell, reverse engineer or misuse the service, or use it to build a competing product. The customer gives Scandish the right to use the content it uploads only to provide the service. Unless the customer refuses in writing, Scandish may mention the customer's name and logo as a reference.
B11. Limitation of liability
Neither party is liable for indirect or consequential damage, such as lost profit, lost revenue, loss of data that could have been restored from the customer's own records, or damage caused by interruptions. Scandish's total liability under the agreement is limited to the fees the customer has paid for the service during the 12 months before the event causing the damage. These limits do not apply to damage caused intentionally or by gross negligence, or where the law does not allow limiting liability. A claim must be made in writing within 6 months of when the party learned or should have learned of the damage.
B12. Confidentiality
Both parties keep confidential the other party's business information they receive, such as prices, sales figures and technical details, and use it only for this agreement. This obligation continues for 3 years after the agreement ends.
B13. Changes to these terms
We may change these terms. We will tell customers about changes that are significant to them at least 30 days in advance by email or in the service. If a change materially harms a customer, it may terminate the agreement to end when the change takes effect.
B14. Other terms
Neither party is liable for delays or failures caused by events beyond its reasonable control (force majeure), such as power or network outages, failures of third-party providers, strikes, natural disasters or actions by authorities. Scandish may transfer the agreement to a company that continues its business. The customer may transfer the agreement only with Scandish's written consent. Notices are sent by email to the addresses the parties have given.
Part C – For everyone
C1. Personal data
How we process personal data is described in our privacy policy at scandish.app/privacy.
C2. Governing law and disputes
These terms are governed by the laws of Finland. The parties will first try to settle disputes by negotiation. Disputes between Scandish and business customers are settled in the Helsinki District Court. A consumer may also bring a dispute to the district court of their home municipality or to the Consumer Disputes Board (kuluttajariita.fi).
